INTRODUCTION

The following Terms of Service describe the conditions that you agree to abide and adhere to whenever you use ValetSeating.com or contact us by phone or email.  The Terms of Service will also improve your purchase process.  Our Privacy Policy conveys the importance we associate with your privacy, and provides our commitment how your interaction with Valet Seating will be treated.

 

ABOUT US

 

Valet Seating, the trademark and trade name for Valet Seating, LLC, is an Arizona corporation, with its principal place of business located in Scottsdale, Arizona, and accessible Online either through the World Wide Web or by Phone.

 

Valet Seating is a privately owned and operated company, and is not affiliated with any box office, venue, sponsor, sports team, sports organization, or ticketing agency that acts in a retail capacity in behalf of a venue, team, or performer (such as Ticketmaster).  Valet Seating operates in the Secondary Ticket Market, which resells premium seating tickets at market conditions for sold out and hard to find events, and consequently our selling price will be higher than the price printed on the ticket.

Any third party trademarks, photographs, or copyrights used by us on ValetSeating.com are for descriptive and/or identification purposes.  They are not endorsements of Valet Seating, either by the organizer(s) or sponsor(s) of any event.

 

Valet Seating, your premium seating destination, provides premium and hard to find tickets for events, while simultaneously providing our customers with the highest level of customer service, satisfaction, and professionalism.  Additionally, to maximize your satisfaction and provide our customers with the largest seating selection possible to any particular event, Valet Seating acts as an intermediary between buyers and other ticket brokers.

 

AGREEMENT WITH THE TERMS OF SERVICE

 

By visiting, using or ordering from Valet Seating, either through the Internet, by Phone, or Fax, you expressly agree to be bound by the following Terms of Service, and to adhere to these Terms of Service as well as all applicable laws and regulations.  If you break these Terms of Service Valet Seating reserves the right to cancel your ticket order, prevent your future use of this Web site, and take whatever appropriate legal action and remedies that are available and necessary.

 

LIMITATION OF LIABILITY

 

Any user of Valet Seating acknowledges and agrees that their usage is done so at their own risk.  We cannot guarantee that Valet Seating's service will be error free or uninterrupted.  Additionally, we cannot guarantee the accuracy, reliability, content of any information, or the service that is provided. 

Neither us, or our affiliations, officers, employees, third party content providers, or licensors, warrant that ValetSeating.com's service will be uninterrupted or error free, and cannot be held liable regardless of the cause or duration, for any interruptions, errors, inaccuracies, omissions, or defects in, or un-timeliness or un-authenticity of, the information and data contained within ValetSeating.com.

 

Except in jurisdictions where such provisions are restricted, in no event will Valet Seating be liable to you for any indirect, consequential, exemplary, incidental, special or punitive damages, including lost profits, even if Valet Seating has been advised of the possibility of such damages.

 

In the unlikely event that we are unable to fulfill the ticket order, our liability is limited to returning any payment previously made for undelivered tickets.

 

We are not responsible for any delay causing you to arrive late or miss your event for any reason.  Any actions by us that result in you missing the event will be rectified with our liability not exceeding your total purchase price.

We are not responsible for the conditions or actions of the crowd or personnel at any event.

In the event that we are required to seek legal remedies to recover fees and/or resolve disputes, you agree that we are entitled to recover all costs associated with such actions caused by the customer, including but not limited to, all reasonable attorney and administrative fees.

 

INDEMNITY

 

You agree to indemnify and hold Valet Seating, along with its subsidiaries, affiliates, officers, employees, agents and other partners, harmless from any loss, liability, claim or demand, including reasonable attorney's fees, made by any third party due to or arising out of your usage of this Web site.

 

TICKET SELECTION, PRICING & PURCHASE POLICY

 

Event Information:
All event dates and times are listed as local for the city in which the event takes place.  It is published on our Web site and printed on the tickets.  However, they are always subject to change, especially sporting events that are subject to TV scheduling conflicts.  Consequently, it is the responsibility of the customer to verify this information prior to the event, by periodically contacting the official Web site of the performer, or the Venue, to ensure your timely arrival.

 

Some events and venues may enforce age restrictions to a particular event.  Consequently it is the customer's responsibility to determine whether such a policy is in effect prior to purchasing your tickets, and if it will affect your admittance to the event, and consequently your purchasing decision.  Valet Seating cannot be liable for refusal of attendance based on this restriction.  Additionally, we cannot be held responsible for providing information or instructions regarding particular event or venue policies.  It is suggested you go to the official Web site of the performer and/or venue for any specific policy that may affect your admittance.

Some events have adult themes, and are not appropriate for children or non-mature audiences.  It is always the customer's responsibility to determine whether the content of an event is appropriate for the customer or others in their party.  We cannot be held responsible for the activity that transpires during an event.  There will be no refunds, credits or exchanges for any of these conditions.

 

Venue Information:
While we provide information concerning normal and anticipated seating arrangements associated with a particular venue, changes can be made by the promoter, band, or venue without our knowledge.  We cannot be held liable for changes made to the layout of the stage or seating configuration, and the customer assumes full responsibility for the final venue arrangement and layout.

 

Ticket Availability:
Due to the highly dynamic nature of the industry, all tickets are subject to availability.  Since our Online ordering function is not in "real time", occasionally tickets that are ordered by customers are no longer available in our inventory. 

 

If tickets that were ordered are no longer available, there is usually an option to purchase tickets in a similar seating location, at the same or similar price, or if equivalent or better seat locations are available at the same price, and you have chosen to be automatically upgraded, we will fill your order with the alternative tickets.  If you have chosen to not be automatically upgraded, and the requested tickets are no longer available, a customer service representative will contact you to discuss alternative seat locations, and your credit card will not be charged until we have received your authorization to fill the order with alternative tickets.

 

In the event that our inventory is listed with incorrect prices or descriptions generated from a typographical error or incorrect information received from our suppliers, we reserve the right to cancel the order.

Due to the dynamic heavy demand of many events, that typically can see a rapid depletion of Inventory and a simultaneous rapid increase of ticket prices all within a single day, ticket availability and ticket prices cannot be guaranteed until an order has been confirmed and payment has been made.

 

Ticket Pricing:
All prices are listed in U.S. Dollars, and on a Per Ticket basis.  The vast majority of the tickets that we offer are often listed significantly higher than their face value.  We acquire our inventory through a variety of methods that include but is not limited to, season ticket holders, and individuals with extra tickets to an event.  You will not find any relationship to the prices listed on our Web site, and the price that is printed on the ticket.  Prices listed on our Web site are based on the market value (which considers the cost and difficulty of obtaining the tickets, supply & demand, and other factors including service charges), which generally speaking when added together is far greater than the face value that is printed on the ticket.


Purchase Policy
All sales are final - - no exceptions.  Because of the highly dynamic nature of the secondary ticket market, once an order has been placed, there are no refunds, cancellations, or exchanges.  We reserve the right to refuse or cancel an order and give a full refund at any time, for any reason.  We are not responsible for lost or stolen tickets (that we shipped and you received), change of venue, date, time, or rainout.  Because Valet Seating also acts in many instances as an intermediary between the customer and other ticket brokers, Valet Seating shall not be liable for any pricing or typographical errors.


FORMS OF PAYMENT, ORDER PROCESSING, & FRAUD PREVENTION

 

Forms of Payment:
We accept Visa, MasterCard, and American Express, Online through our Web site and over the Phone.  If timing permits, we also accept checks and money orders.  If payment is made by personal check, the shipment of tickets will be made after the check has cleared, which can take 7-10 business days.

 

Order Processing & Order Confirmation:
You will receive an email immediately after you place your ticket request, confirming that we have received your request for tickets.  This does not confirm availability or prices, as it only indicates that we received your ticket request.  Unlike Sales conducted over the Phone, Sales conducted through the Internet are not processed in real time.  Consequently we will contact you if we are unable to fill the order that you submitted.  At that time we will advise you of the current seating inventory that remains available for purchase.  Your ticket order (including the ticket price, quantity, and availability) are guaranteed at the time your order is confirmed by us with a copy of your invoice.  If you do not receive an email order confirmation within two full business days, please contact Valet Seating at 480-614-1902 to check your order status.

 

Pre-Orders:
Some tickets that are made available through Valet Seating are known as Pre-Order tickets.  This type of ticket is made available for purchase to you the customer, prior to our physical receipt of the ticket since they have yet to be printed and/or delivered to Valet Seating.  Once the tickets are received by us, they will be shipped to you immediately.  In some situations, because of the delay in our receipt Pre-Order tickets, we are not able to deliver the tickets until the week of the event.

 

Fraud Prevention:
To avoid any delay in processing and shipping your order, your name and billing address must match precisely with the information on file with your credit card company or the transaction will be denied.  We also reserve the right to request a Credit Card Authorization Form at our discretion.  When an Authorization Form is required, it is done to protect both the cardholder and the company from fraudulent use.  In such situations we will send you a Credit Card Authorization Form, either by email or fax.  In turn you will need to fill out the form and fax it back to Valet Seating, along with a copy of your photo ID (such as your Drivers License), as well as a front and back copy of the credit card you are using for your purchase.  If such documentation is requested and not supplied, the order will be cancelled.

 

TICKET SHIPMENT & DELIVERY - METHOD & POLICIES

 

Delivery Method:
FedEx is used for all shipments, and a signature is required upon delivery, for every order.  FedEx will NOT deliver to a P.O. Box, consequently you must provide us a physical address that will have an individual present to sign for the delivery.  Moreover, you should notify Valet Seating immediately, prior to the order being shipped, if there are changes to the shipping address.  Most orders are shipped within 24 to 48 hours after confirmation.  However, some orders are not able to be delivered until very close to the date of the event.  If the shipment needs to be re-directed while it is in transit for delivery, the customer is obligated to pay any and all address correction fees charged by FedEx. If customer has enabled "signature waiver" with Fedex or UPS, Valet Seating is not responsible for any packages that may become lost. Valet Seating has no control if a customer enables this feature on their address.

 

Incorrect & Damaged Tickets:
Upon receipt of the tickets, please verify and contact us within 48-hours concerning any mistakes or discrepancies about the tickets that you received, such as tickets shipped in the wrong row or section, the tickets are for a different event or date, or the tickets are damaged.  In matters such as these we will make every effort to correct the problem immediately.  If the tickets ordered are no longer available, and replacement tickets are not an option, the order will be cancelled.  In such instances the customer must ship the tickets to Valet Seating to receive a refund.  There are absolutely no cancellations, refunds or exchanges on orders that have no discrepancies.

 

Undeliverable Tickets & Refused Shipments:
If for any reason your tickets are returned to us or could not be delivered, we will try to contact you to arrange another delivery attempt, and a second delivery charge will apply.  Due to the dynamic nature of the secondary ticket market, Valet Seating has fulfilled its contractual duty when tickets are shipped to the address provided by the client.  Valet Seating is not responsible for any incorrect addresses provided by the customer or for the package being returned to sender due to the client, or an authorized representative, not being available to sign for the package at the time of delivery.  Valet Seating retains all packages that are returned by Federal Express, for later re-delivery to the customer.  Additionally, Valet Seating is not responsible for any customer caused delays in delivery after the order has been shipped.

 

Will-Call / Pick-Up:
In certain instances, tickets are not available to us in what is considered an adequate lead time, that would allow us to ship the tickets to you via FedEx, in advance of the event.  In this situation the tickets will be made available for your pick-up at a designated will-call area on the day of the event.  A photo ID is required for all will-call pickup locations.

 

Lost or Damaged Tickets After Delivery:
Since we are not the original source of the tickets, we are unable to reprint or reissue tickets.  We cannot issue replacement tickets should yours become lost, stolen or damaged after they have been received by the customer.  Upon receiving the tickets, it is your responsibility to keep them in a safe, secure place until the event.  Tickets should not be left in direct sunlight, extreme heat or high moisture, and protected from liquids and other harmful agents, as this can damage tickets to the point of rendering them unusable.

 

PRIVACY POLICY

 

Overview:
Valet Seating, LLC, is committed to protecting the privacy of our customers and visitors to our Web site.  This Privacy Policy will describe how we collect information from customers and visitors, what we do with that information, and the security you have when entering sensitive information over the Internet.

 

Information that is gathered:
The IP (Internet Protocol) address and browser type of each visitor is automatically recorded in our Web site usage logs.  This information assists us in administering our Web site, make it more operationally more efficient, and provide our visitors an overall better quality experience when they visit our site.  This information is not used to individually identify any single user or groups of users.  Therefore users remain completely anonymous with the type of information that is gathered.

 

When a user becomes a registered user, or makes a purchase on ValetSeating.com, we will collect full contact details and payment information from the customer.  This information will not be sold or revealed to third parties.  It will primarily be used to communicate with the customer, in order to fulfill the order promptly.

 

Cookies:
Cookies are small text files that your web browser creates and stores in a cookies folder on your hard drive.  These text files have no way of carrying viruses or inflicting any damage upon your computer.  The cookies that we store for the period of your visit, do not in any way allow us to view the rest of the contents of your computer, control your computer in any way, or extract any personal information stored in files on other parts of your computer.

 

Cookies are used to allow our shopping cart to function properly.  Therefore, you will need to have cookies enabled in your browser in order to purchase tickets from us.

 

Your payment information, home address and other contact details are NOT stored in the cookie once you exit our Web site.  The cookie only lasts for the period that you remain on our Web site and use the shopping cart to make a purchase.

 

Security of sensitive data:
All transactions are carried out on a secure server, and encrypted with full 128-bit Secure Socket Layer (SSL) encryption.  Customer information stored in our Online database is protected from hacking attempts by industrial strength firewall software and database protection measures.  User will select a user name and password as part of the registration process.  The user is fully responsible for maintaining the confidentiality of their user name and password.  Valet Seating, LLC will not sell or rent User's Personal Information to any individual, business or government entity, unless requested by user or if Valet Seating is required to respond to court orders, subpoenas, or other legal process.

There may be links throughout ValetSeating.com that take you to third party Sites on the Internet that are not owned or operated by Valet Seating, LLC.  We have no control over these sites or the content that they contain, and cannot guarantee or warrant that they are accurate, legal and not offensive.  We do not endorse the content of any third party Web site, nor do we warrant that they will not contain viruses or otherwise impact your computer.  By accessing these third party Web sites, you agree and understand that you may not make any claim against Valet Seating, LLC, for any damages or losses whatsoever, resulting from your use of any of the Web sites linked within our site.

 

TYPOGRAPHICAL ERRORS

In the event a product is listed at an incorrect price or with incorrect information due to typographical error, error in pricing, or product information received from our suppliers, Valet Seating has the right to refuse or cancel any orders placed for the product(s) listed at the incorrect price.

 

CANCELLATION, RESCHEDULED EVENTS, & REFUND POLICY

All sales are final.  Because of the dynamic nature of the secondary ticket market, once an order has been placed, there are no refunds, cancellations, or exchanges - - there are no exceptions to this policy.  This policy is necessary, because once you place an order we will either immediately initiate action to secure the tickets you requested from authorized brokers, or remove the tickets from our available inventory to the general public.  In either situation, any attempt to retrace our steps backwards will incur additional cost, as well as incur a significant (if not a 100%) cost penalty.  Additionally, there are no refunds or exchanges for postponed or rescheduled events or time changes. 

 

DISPUTES

If there is any dispute about or involving this Site, by using this Site you agree that the dispute will be governed by the laws of the State of Arizona, without regard to its conflict of law provisions.

 

MODIFICATIONS TO THE TERMS OF USE & PRIVACY POLICY

Valet Seating has the right to change or discontinue any aspect or feature of ValetSeating.com, and also maintains the right to change these Terms of Service and Privacy Policy at any time.  Posting updated Terms of Service and Privacy Policy on this site will make the new Terms of Service and Privacy Policy effective immediately and binding on all users of this Web site.

 

ENTIRE AGREEMENT

These Terms of Service and Privacy Policy constitute the entire agreement between Valet Seating and the user.
